04 Feb No Discrimination for Gay Employees
No matter their politics, people want the right to work for any employer without being discriminated against; not for being Indian, Muslim, nor gay. It is being reported in the news that Ivanka Trump and her husband ensured that the new administration would not take away any rights from gay, lesbian, transsexual, or bisexual people — a good thing in the minds of my fellow Democrats, but I digress . . . In my law office we believe that everyone has the right to be represented and everyone has the right not to be discriminated against. Gay employees who come to us with an employment law case will receive the same treatment as anyone else. Very recently, we represented a couple of gay clients, one was a woman and one was a man. Both had divorce cases and one of them also had a domestic violence case.
Every case is handled the same according to the unique facts of the case. An interesting part of one of the cases we had revealed some potential underlying employment discrimination. The other party in one of the cases was being investigated for some of his behavior, and it was obvious that he was trying to keep his sexual orientation a secret. He said that he and his husband were friends. He repeated this even during trial. However, because his husband was not ashamed to be gay, this fact was revealed in court and it was revealed to his employer.
There is pretty strong evidence that it is more acceptable to be gay than it used to be, and people are not stigmatized as much in 2017 as they were in 1990. Hopefully, more gay, lesbian, transsexual, and bisexual people will feel that it is okay to be who they are. It should always be okay to be who you are as long as it does not harm anyone else. As an attorney who must maintain confidentiality with my clients, I hope that all relevant truths are told to me. If you are gay, and it is relevant to your case, please do not hide it. No one is perfect, but the more authentic you are with your attorney, the better your attorney can represent you. As I always say, we are a team, help me help you.
